We wish to inform you that the Minister of Transport has issued Protective Direction no. 37, effective June 6, 2016, to require top-fitting protection for retrofitted TC/DOT-111 tank cars in Canada. These requirements will enhance the safety of the transport of flammable liquids including crude oil and ethanol in Canada, and will align Canadian requirements with those for retrofitted TC/DOT-111 tank cars in the U.S.

The TC-117R standard for retrofitted tank cars was published as an amendment to the Transportation of Dangerous Goods Regulations on May 20, 2015. At the time of the development of the standard, there were technical complexities preventing it from including top fitting protection requirements for retrofitted legacy TC/DOT-111 tank cars. Top-fitting protection can reduce the risk of a dangerous goods spill in the event of a tank car derailment.

The Association of American Railroads (AAR) subsequently developed an engineering solution to enable top-fitting protection on these legacy tank cars.  With the publication of the Fixing America’s Surface Transportation (FAST) Actin the U.S., this engineering solution became a requirement for retrofitted U.S. DOT-111 tank cars, along with other retrofitting requirements under the DOT-117R standard in the U.S.

With the issuing of Protective Direction no. 37, TC/DOT-111 tank cars will be required to include top fitting protection meeting the engineering specifications prescribed therein when they are retrofitted as per the phase-out schedule for flammable liquid tank cars in the Transportation of Dangerous Goods Regulations.

Nous souhaitons vous informer que le ministre des Transports a émis l’ordre n^o 37, qui entrera en vigueur le 6 juin 2016, en vue d’exiger l’installation de dispositifs de protection des accessoires supérieurs sur les wagons-citernes TC/DOT-111, lesquels ont fait l’objet d’une mise à niveau au Canada. Ces exigences permettront d’accroître la sécurité du transport des liquides inflammables au Canada, y compris le pétrole brut et l’éthanol. Elles permettront également d’aligner les exigences canadiennes par rapport à celles des États-Unis visant les wagons-citernes TC/DOT?111 qui ont fait l’objet d’une mise à niveau.

La norme visant les wagons-citernes TC-117R qui ont fait l’objet d’une mise à niveau a été publiée le 20 mai 2015, à titre de modification au Règlement sur le transport des marchandises dangereuses. Au moment de l’élaboration de cette norme, certaines complexités techniques ont empêché l’intégration des exigences quant aux dispositifs de protection des accessoires supérieurs des wagons-citernes TC/DOT?111 existants ayant fait l’objet d’une mise à niveau. Or, ces dispositifs de protection des accessoires supérieurs peuvent réduire les risques de déversement de marchandises dangereuses.

L’Association of American Railroads (AAR) a par la suite élaboré une solution technique permettant d’installer des dispositifs de protection des accessoires supérieurs sur les wagons-citernes existants. Avec la publication de la Fixing America’s Surface Transportation (FAST) Actaux États-Unis, cette solution technique constitue maintenant une exigence pour les wagons-citernes DOT?111 existants ayant fait l’objet d’une mise à niveau.

Les wagons-citernes TC/DOT?111 devront désormais être munis d’un dispositif de protection des accessoires supérieurs tel que décrit dans le présent ordre lorsqu’ils font l’objet d’une mise à niveau conformément à la période de retrait graduel des wagons-citernes transportant des gaz inflammables énoncée dans le Règlement sur le transport des marchandises dangereuses.
